Terms of service
On this page
1. Who you are contracting with #
These terms are an agreement between you and Simvito Limited, which trades as Simvito ("we", "us").
By buying or using a Simvito eSIM you accept these terms. If you do not accept them, do not buy or install the product.
2. What we provide #
Product: prepaid mobile data plans delivered as eSIM profiles.
Data only: unless a plan says otherwise, there is no phone number, calls or SMS.
Emergency calls: the service cannot make emergency calls. Keep a line on your device that can reach local emergency numbers.
3. Eligibility and your device #
Age: you must be 18 or over. Under-18s need a parent or guardian to order in their own name.
Device: it must support eSIM and not be carrier-locked. Check on our device page before you buy.
4. Prices and orders #
Prices: shown in the currency you choose, including applicable taxes. The amount at checkout is the amount charged.
Price changes: the price shown when you pay is the one that applies; later changes do not affect a paid order. If the price changes during checkout, we ask you to confirm the new amount before charging.
Pricing errors: if a price was shown in error, we may cancel the order before delivery, refund it in full and tell you.
Contract: the contract is formed when we deliver the eSIM.
5. Payment methods and security #
Cards: Visa, Mastercard and JCB.
Wallets and local methods: Apple Pay and PayPal, plus local methods such as Alipay, PayNow, Pix and GCash. Checkout shows the methods available for your currency.
Security: payments travel over encrypted connections and are handled by licensed, PCI DSS-compliant payment providers. We never receive or store your full card number, expiry date or security code.
Verification: card payments may require 3D Secure verification by your bank.
6. Delivery #
How: electronically, to the email address given at checkout, usually within 5 minutes of payment. Nothing is shipped.
Wrong email: contact support and we will resend to the correct address. See the delivery policy.
7. Your account #
Sign-in: you sign in with Google or Apple before paying, and your orders, installation details and usage are kept in your account.
Account security: we never see your Google or Apple password. Keep that account safe: anyone who can sign in can see your orders and installation codes.
Closing your account: you can ask us to close it at any time. Closing it does not cancel plans already bought and is not a refund request; see the refund policy.
Misuse: we may suspend or close an account used in breach of these terms.
Payment risk: if a payment looks unusual or may involve someone else's card, we restrict the account while we review it. While restricted, it can't make purchases, top up, add balance or pay with balance.
8. Activation and validity #
Validity: counted according to the plan's start rule and day counting, and runs continuously once started, including days you do not use your phone.
Data used up: the plan slows down or stops, as stated for that plan.
Expiry: the plan ends when its validity ends. Unused data has no cash value and does not carry over.
Installation: each QR code installs once. A profile that is deleted, or lost when the device is erased or replaced, cannot be reinstalled and is not replaced free of charge.
9. Acceptable use #
Allowed: normal personal or business travel use, including personal hotspot where the local network permits.
Not allowed: reselling; long-term roaming in your home country; continuous machine traffic from routers, cameras or similar devices; sending unsolicited bulk messages; any unlawful purpose.
Enforcement: if usage is grossly beyond normal travel use or there is abuse, we may suspend or end the plan. If we do so without good cause, we refund the unused portion.
10. Coverage and quality #
What affects it: coverage, speed and availability depend on terrain, buildings, congestion, maintenance and local regulation, which are outside our control.
No guarantee: we publish the countries and regions each plan covers, but cannot guarantee uninterrupted service, particular speeds or availability at a specific place.
11. Refunds #
Refunds follow our refund policy, which is part of these terms. In short: an eSIM that has not been activated can be refunded in full within 30 days of purchase (except, once issued, plans whose validity starts at payment), and a plan that fails for a technical reason we cannot fix is refundable whether or not it was activated.
Right of withdrawal (consumers in the EU, EEA and UK): you normally have 14 days to withdraw from an online purchase. An eSIM is digital content delivered as soon as you pay, so at checkout we ask you to agree to immediate delivery and to confirm that you know your right of withdrawal ends once delivery begins. The refund policy above still applies.
12. Our liability #
Not excluded: liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.
Cap: otherwise, our total liability for a plan is limited to what you paid for it.
Indirect loss: we are not liable for indirect or consequential loss, such as missed connections, lost bookings, or loss of business or data.
13. Privacy #
We handle personal data under our privacy policy and Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486).
14. Changes to these terms #
We may update these terms. The version published when you buy applies to that purchase; changes do not apply to plans already bought.
15. Governing law and disputes #
These terms are governed by the laws of the Hong Kong Special Administrative Region, and its courts have exclusive jurisdiction. If you are a consumer elsewhere, this does not affect the protection of mandatory consumer law where you live.
Before starting formal proceedings, please email support@simvito.com and give us the chance to resolve it directly.
